Acceptance of Terms

These Terms of Use (“Terms”) govern the use of the websites (“Site”) operated by FTFSOCIAL LLC (“FTFSOCIAL,” “us,” “we,” or “our”).

By accessing or using the Site, you (“user,” “visitor,” or “client”) agree to these Terms. If you do not agree, you may not use the Site.

If you have signed a Master Services Agreement (MSA) with FTFSOCIAL, the terms of the MSA will control in the event of any conflict with these Terms.

Changes to the Terms

FTFSOCIAL may change these Terms from time to time by posting a revised version on the Site. Changes are effective ten (10) business days after posting. Continued use of the Site after changes are posted constitutes acceptance of the modified Terms.

Content

Our Site contains original material, including without limitation information, software, graphics, text, videos, templates, and branding elements (collectively “Content”). Content is protected by intellectual property laws.

FTFSOCIAL grants you a limited, non-transferable, non-exclusive, revocable license to view and use Content for legitimate business purposes related to evaluating or engaging FTFSOCIAL’s Services.

Authorized Uses

You agree to:

Use the Site and Services in compliance with all applicable laws.

Provide accurate, truthful, and complete information when requested.

Use Site features, resources, and materials solely for your business purposes or as a prospective client evaluating Services.

Prohibited Uses

Unauthorized use of the Site, Content, or Services is strictly prohibited. You agree not to:

Sell, license, sublicense, transfer, or exploit Content without authorization.

Subscriptions and Services

Certain Services available through FTFSOCIAL are subscription-based (including Social Media Management, PPC Advertising, Website Management, the FTFSOCIAL Marketing Hub, and App Management).

Subscriptions require payment of applicable fees.

All sales are final. Payments are non-refundable except as expressly stated in the MSA.

All subscriptions and billing terms are subject to the terms of the MSA where applicable.

Subscriptions automatically renew unless canceled in accordance with the MSA (minimum thirty (30) days’ prior written notice).

User Submissions

If you provide materials to FTFSOCIAL (logos, photos, videos, content, or data):

You represent and warrant that you own or have the right to use such materials.

You grant FTFSOCIAL a limited license to use, reproduce, modify, or display such materials for the purpose of fulfilling Services.

You are solely responsible for any damages, claims, or losses resulting from submitted materials.

Intellectual Property

The Site contains intellectual property owned by FTFSOCIAL and its licensors. Unauthorized use of FTFSOCIAL’s intellectual property may result in civil and criminal liability.

Copyright Infringement Notification & DMCA

If you believe Content on the Site infringes your copyright, provide FTFSOCIAL with written notice including:

Your name, address, telephone, and email.

A description of the copyrighted work.

Identification of the allegedly infringing Content.

A statement of good faith belief the use is unauthorized.

Third-Party Information and Integrations

The Site may provide links or integrations with third-party services (Google, Meta, Squarespace, Homestack, etc.).

FTFSOCIAL does not control or endorse third-party sites.

Third-party platforms may have their own terms and privacy policies.

You access third-party integrations at your own risk.

Confidentiality

Users must maintain confidentiality of any non-public information provided by FTFSOCIAL, including client portal access, training content, or strategic templates.

Termination of Use

FTFSOCIAL may suspend or terminate access to the Site or Services, with or without cause, if you violate these Terms.

Termination of Services is also governed by the MSA.

Warranty Disclaimer

YOUR USE OF THE SITE IS AT YOUR OWN RISK.

The Site, Services, and Content are provided “AS IS” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Representations and Warranties

By using the Site, you represent and warrant that you:

Have authority to enter into these Terms.

Will comply with all applicable laws.

Will not use the Site for fraudulent or unlawful purposes.

Indemnification

You agree to indemnify and hold harmless FTFSOCIAL, its officers, employees, contractors, and affiliates against any claims, damages, liabilities, or expenses arising from your violation of these Terms or misuse of the Site.

Limitation of Liability

For general website visitors, FTFSOCIAL’s liability for claims related to the Site is limited to one hundred dollars ($100).

For clients with a signed MSA, the limitation of liability provisions in the MSA shall control.

Compliance with Laws

You agree to comply with all applicable laws, including privacy, consumer protection, and data protection laws.

Privacy

Your use of the Site is subject to FTFSOCIAL’s Privacy Policy, incorporated herein by reference.

Arbitration (“Agreement to Arbitrate”)

Any disputes arising from your use of the Site shall be resolved by binding arbitration in Pinal County, Arizona, under the rules of the American Arbitration Association.

For clients with a signed MSA, the arbitration provisions of the MSA shall control.

Other Terms

A. Choice of Law and Venue. These Terms are governed by the laws of Arizona.

B. Severability. If any provision is invalid, the remaining provisions remain enforceable.

C. No Waiver. Failure to enforce any right does not constitute a waiver.

D. Entire Agreement. These Terms, together with the Privacy Policy and any applicable MSA, constitute the full agreement.

E. Assignment. FTFSOCIAL may assign rights under these Terms without consent.

F. Survival. Indemnification, limitation of liability, arbitration, and confidentiality survive termination.

G. Publicity Rights. Unless requested otherwise in writing, FTFSOCIAL may use your company name and logo in marketing or portfolio materials.
